Irregular Migration in Mexico: A Challenge for the Rule of Law and the Protection of Human Rigths: Un reto para el Estado de Derecho y la protección de los Derechos Humanos

Abstract

Public policies in Mexico and its relationship with the neighboring country United States of America have demostrated a tension when it comes to irregular migration, which is one of the most complicated challenges to address, in order to consolidate the Rule of Law in Mexico, since, based on the premise “in the Rule of Law Human Rights are respected”, the irregular migratory crisis, opens the panorama to the analysis of diverse violations of Human Rigths, which in themselves alredy existed before the recent tensions in international relations, therefore, in this research article, The  objetive is to provide concepts and bibliographic bases of the Rule of Law in Mexico, The current indexes, Delve into the influence of irregular migration on the Human Rigths of the irregular migrant comunity, analyzing relevant cases of human rigths violations against migrants and give a vision on the Writ of Amparo as the ideal means of protection of Human Rigths, using a qualitative method of documentary research, base don diverse doctrinal bibliographic sources, statistical data, national and international legislations, to demostrate that irregular migration in Mexico is a great challenge for the Rule of Law in Mexico, which can be addressed using a effective means of defense that guarantee the Human Rights of all.
